Creditors' Rights


Since entering private practice, Bryan Sims has been advising and representing creditors in their actions to enforce their rights to collect money owed to them or to secure property in which they have a security interest.

These activities include things such as filing lawsuits to collect money owed or filing a replevin action to recover the property. Bryan has also represented creditors in bankruptcy proceedings in matters such as seeking to lift a bankruptcy stay as well as adversary proceedings seeking to prevent the dischargability of a debt.

Additionally, Bryan has assisted creditors in ensuring that their security interest in debtors' assets are protected.

Although collecting money from a debtor is never guaranteed, Bryan has experience in using a variety of enforcement mechanisms, such as citations to discover assets, wage garnishments, non-wage garnishments, levies, and challenging transfers as fraudulent conveyances.
